BREAKING NEWS: State granted six week adjournment for crucial cellphone evidence in IFP leaders’ case

IFP Councillor Mthembeni Majola, Endumeni (Dundee) Local Municipality Mayor Richard Mbatha and alleged hit man Xolani Makhathini had their bail prolonged as the state gather crucial evidence against them.

Minuets ago the  Inkatha Freedom Party’s leaders Party Councillor Mthembeni Majola, Endumeni (Dundee) Local Municipality Mayor Richard Mbatha alongside alleged hit man Xolani Makhathini reappeared in the Estcourt Magistrate’s Court.

Senior Public Prosecutor Mr Zuma requested a postponement of six weeks to gather the necessary cellphone and cell mapping records. The state believes this will be significant to the case.

The defence opposed the six-week long postponement saying that the case is only based on the Investigating Officer’s affidavit, which was riddled with inconsistencies. The defence wished to remind the court that the accused are entitled to a speedy trail.

After taking both sides into consideration, Magistrate Sam Mpungose granted an adjournment of six weeks for further investigation as the evidence that can be gathered was the backbone of the state’s case.

The three accused bail is extended with the same conditions. This is the final postponement date for further investigation. The case will resume on August 13.
