The Inkatha Freedom Party (IFP) duo and co-accused’s case was on the roll in court earlier this morning, but this time they appeared in the Estcourt Regional Court.
IFP Councillor Mthembeni Majola, Endumeni (Dundee) Local Municipality Mayor Richard Mbatha and alleged hit man, Xolani Makhathini each face two counts of conspiracy to commit murder.
Despite, Control Prosecutor Ms Bongeka Hlatshwayo announcing during their last appearance in B Court on August 13, that the case is ready for trial, this was not so.
State Prosecutor Mrs Mosia while announcing the case, told Magistrate Goosen that the docket was not available and that she was informed that State Prosecutor Ms Nel from Bergville would handle the case, as one of the accused is a local.
Ms Nel who is reportedly sick, was not present, therefore the matter stood down after numerous suggestions were made for a way forward.
“In order to avoid the accused, one of which is wheelchair bound from appearing unnecessarily in court, we will select a date where everyone can avail themselves for the docket to be handed over,” explained Magistrate Goosen.
The case has been postponed to October 2. The docket and video footage, if any, will be viewed by the defence teams to prepare for pre-trial .
